Effective Date: [Insert Date]

Introduction

These Terms and Conditions (“Terms”) govern the delivery services provided by Blossom Flower LLC (“Blossom Flower”, “we”, “our”, or “us”) for the delivery of cannabis products within Massachusetts. By using our delivery services, you (“Customer”, “you”, or “your”) agree to these Terms, which comply with the Massachusetts Cannabis Control Commission (CCC) regulations, including the 935 CMR 500.000 series.

  1. Legal Compliance

Blossom Flower LLC operates in full compliance with the laws and regulations of the Commonwealth of Massachusetts, including the Cannabis Control Commission’s 935 CMR 500.000. Our services are intended for legal, adult-use cannabis consumers aged 21 and older or qualified medical marijuana patients with a valid medical marijuana card.

  2. Eligibility and Account Requirements

    • Age Requirement. You must be at least 21 years old to receive recreational cannabis deliveries, or a valid medical marijuana patient with proper documentation to receive medical cannabis.
    • Verification. We reserve the right to verify the age and identity of any customer using our delivery services. Acceptable identification includes a valid Massachusetts driver’s license, government-issued ID, or medical marijuana card.
    • Delivery Area. Deliveries are available only within the state of Massachusetts. Specific delivery areas may be subject to availability and regulatory restrictions.
  3. Ordering and Delivery

    • Ordering. To place an order, customers must complete a purchase through our official delivery portal, providing all required information, including order details, delivery address, and legal ID.
    • Delivery Times. We make reasonable efforts to deliver within the selected window; however, times are not guaranteed and may be delayed due to traffic, weather, or logistical challenges.
    • Delivery Charges. Delivery fees may apply and will be stated during checkout. We may adjust fees based on changes in fuel costs, logistics, or other operational factors.
    • No Delivery to Restricted Locations. We will not deliver to locations prohibited by Massachusetts law (e.g., schools, government buildings, or other areas where cannabis delivery/consumption is prohibited).
  4. Payment

    • Payment Method. Payments must be made through our authorized payment methods at the time of order. Blossom Flower LLC accepts [Insert Payment Methods].
    • Taxes. All applicable taxes (including sales and excise taxes) will be added as required by law.
    • Refunds and Cancellations. Once an order is confirmed and processed, cancellations or changes are not allowed. Refunds may be issued only if an order cannot be fulfilled due to our error.
  5. Delivery Process

    • Identification Check. The person receiving the order must present valid ID matching the order and meeting the age requirement.
    • Signature Requirement. A recipient signature is required to complete delivery.
    • Failure to Provide Identification. If valid ID is not provided upon delivery, the order will not be completed and no refund will be issued.
  6. Compliance with State Law

    • Product Limits. Customers may receive only the quantities permitted by Massachusetts law. For adult-use customers, the maximum possession is 1 ounce of cannabis or 5 grams of concentrate. Medical patients may possess higher quantities per their status.
    • Track and Trace. We use the METRC system to track and report all cannabis transactions for regulatory compliance.
    • Security and Transportation. All cannabis products are securely packaged and transported in accordance with CCC security and vehicle requirements.
  7. Prohibited Activities

    • No Redistribution. Customers may not resell or redistribute any cannabis products delivered by Blossom Flower LLC.
    • Consumption Restrictions. Consumption is prohibited in vehicles during transit. Deliveries must be received at a private residence or other authorized location.
  8. Privacy and Confidentiality

We respect your privacy and protect your personal information in accordance with our Privacy Policy and applicable laws, including CCC privacy and data-security regulations.

  9. Limitation of Liability

We are not liable for delays, damages, or losses caused by circumstances beyond our control, including weather, traffic, road closures, or actions by third parties. Our total liability for claims arising from use of our delivery services is limited to the amount you paid for the order.

  10. Modifications to Terms

We may modify these Terms at any time. Significant changes will be communicated via email or our website. Continued use of the delivery services constitutes acceptance of the updated Terms.
